General UsedCars-USA.com is a vehicle listing and information service. This site helps bringing buyers and sellers together of used vehicles, parts and accessories. Your use of this site is expressly conditioned on your acceptance of the following terms and conditions. By using this site, you signify your assent to these terms and conditions. If you do not agree with any part of the following terms and conditions, you must not use this site. This Agreement is effective on August 10, 2007 for all users, and may be amended at any time, without any notice to you. All amended terms shall be effective 30 days after they are initially posted on UsedCars-USA.com. By continuing to use this website you agree that UsedCars-USA.com has the right to change, restrict access to, suspend, or discontinue this website, or any portion of this website, at any time.
Use of This Site You understand and agree that the content on this site is for informational purposes only. Despite our best efforts, it is inevitable that some inaccuracies may occasionally be present. Neither UsedCars-USA.com nor advertisers on this site are responsible for typographical errors, mistakes, misprints, including but not limited to, pricing errors, individual vehicle disclaimers, finance options or an incorrect statement of features and/or parts/accessories of a particular vehicle. To the extent permitted by applicable law. Always consult with the seller (dealer or private) over such terms, including price, dealer fees, tax, tag, title, etc. before making your final purchasing decision. We also recommend that you contact the seller (dealer or private) before visiting the lot/vehicle to insure the price is correct and the vehicle is still available for purchase. UsedCars-USA.com is not responsible for any such goods or services and does not guarantee the performance or condition of the selling cars and parts.
Selling Any registered member that lists a car or car parts for sale is a "Seller". Sellers may list as many items as they choose. Sellers must pay all applicable fees and taxes associated with selling on UsedCars-USA.com in a timely manner. If a seller breaches a contract with a buyer, the seller may be subject to remediation described in this User Agreement. UsedCars-USA.com does only allow the listing of cars and car parts on the Site. The selling cars and parts must be located in USA.
As the seller, you agree to treat any prospective buyer in a fair and honorable manner. Responsibility for the information contained in each listing lies with each seller. You alone are responsible for all material you post and for the content of all contacting and email messages transmitted through this website. You are not allowed to use or sell any information provided by a prospective buyer for any purpose other than to contact the buyer or close a transaction, including but not limited to, customer name, address, phone number, mailing address, email address. When listing your vehicle you must be prepared to sell that vehicle for the listed price or lesser at which, and the terms on which, you've listed it. You must have possession of the actual vehicle listed at the time of sale, and you must be legally able to transfer the ownership/title at said time.
By using the service on UsedCars-USA.com you agree not to post or transmit any defamatory, abusive, obscene, threatening, misleading, illegal material, or any other material that infringes on the rights of others to use this site. UsedCars-USA.com has the right to limit access to, suspend, terminate, edit, move, or monitor any listings or other postings that we consider unacceptable or inappropriate, weather for legal or other reasons. The seller will may be charged for listing or extra options that related to the listing. Please see our fee schedule for complete details. If your item doesn't sell, then you have the option to relist it, for as many times as you'd like or until you find a buyer. As always, you can choose to list your item for free or with extra options.
UsedCars-USA.com will not grant any refunds if your item doesn't sell or if you cancel your listing early. Also, if you select to list your item for multiple months and your item sells before the scheduled end date, you are still responsible to pay the entire amount. For example, if you list your item for four months and it sells within one month, you still must pay for the agreed upon remaining months.
Buying Any registered member or unregistered user that buys a car or parts or other items listed on UsedCars-USA.com is a "Buyer." Buyers are responsible for sending timely payment to Sellers for the item(s) they've agreed to buy from the Seller. If a Buyer breaches a contract with a Seller, the Buyer may be subject to remediation described in this User Agreement.
Fees and Costs Buying a car or car parts from Sellers through UsedCars-USA.com are free services. We charge fees for using other services, such as listing cars for sale with more pictures and extra options or banner advertisements. When you use a service that has a fee associated with it, you have an opportunity to review and accept the fees that you will be charged based on our Fees Schedule, which we may change from time to time. All fees are quoted in U.S. Dollars. You are responsible for paying all fees associated with the Site in a timely manner with a valid payment method.
Fees Schedule
Llistings are free with six photo to upload. Featured ad cost for 7 days $1.99, for 14 days $2.99 and for 30 days $4.99 per ad. Featured ads are placed top-most in each category and are shown highlighted. Extended ad cost $4.99 for running 60 days.
Advertising It is not allowed to list any material that promotes any other business or organization within the listing categories. We offer various types of advertising packages for all interested parties. For prices see our Advertising site.
Indemnification Without limiting other remedies, we reserve the right to limit, suspend, prohibit, or terminate our service to any user, at any time, if we feel that the user has: breached this Agreement or any other policy posted on the Site; is creating possible legal liabilities for the Site; or is acting in a questionable manner. Furthermore, we reserve the right to take technical and legal steps to prohibit users from accessing the Site. You agree also to indemnify, defend, and hold harmless UsedCars-USA.com and/or our advertisers and Providers, its and their officers, directors, employees, affiliates, agents, licensors, and suppliers from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation by you of these Agreement.
Copyright All material posted on the Site by people/website users other than from UsedCars-USA.com, is subject to UsedCars-USA.com Copyright Act, Title 17, United States Code, Section 512(c)(2) (the "DMCA"). To make a claim of copyright infringement regarding Content on the Site, please contact us.
Your account With this Terms you agree not to give out any of your account information to any third party or let any third party use your account. You take full responsibility for actions taken under your account, whether or not you are the one taking those actions.
Privacy You have read our Privacy Policy and agree that the terms of such policy are reasonable.
Links to Third Party Websites The site UsedCars-USA.com provides links to other websites. These websites are not controlled by UsedCars-USA.com. UsedCars-USA.com makes no claims about or endorsements of these websites. Also UsedCars-USA.com is not responsible for the contents of these third party websites, or any subsequent links, and has no control over the contents therein. You agree that UsedCars-USA.com is not responsible for any service, content or other material on other websites or provided by others.
Minors If we determine that a user is under eighteen (18) years of age and has submitted information by way of our website, we will immediately delete such information.Minors may not buy or sell on UsedCars-USA.com.
Termination Agreement You agree that UsedCars-USA.com may, at any time and without notice to you, terminate your use of and/or access to the service and delete, modify, or remove any of your submitted materials. A partial list of reasons for such termination is: violation of these TOS or other posted rules, technical or network problems, accidental loss of data, modification or termination of the Service, complaints received by other Site users, negative information about you or your business relevant to your submitted materials that UsedCars-USA.com is made aware of by other means. You agree also and understand that UsedCars-USA.com may terminate your access to the service or remove your submitted materials for cause at its sole discretion. You agree that UsedCars-USA.com is not liable to you or any third party for such an action. You agree that UsedCars-USA.com is not required to provide a refund for any payments made to UsedCars-USA.com if UsedCars-USA.com believes, at its sole discretion, that you have violated these TOS.
Reservation of Rights Any and all rights not expressly granted to you in this Legal Notice are hereby reserved by UsedCars-USA.com.
Notices This User Agreement, together with the Privacy Policy and any other terms and conditions or other policies incorporated herein or referred to herein constitutes the entire agreement between UsedCars-USA.com and the users of UsedCars-USA.com and supersedes any prior understandings or agreements (whether oral or written) regarding the subject matter and may not be amended or modified. No agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is created by this Terms & Conditions.
